Research has shown that the chances of success are high if the hospital takes an interest-based approach in this case. Negotiation is voluntary, less expensive, and offers an opportunity to regain the trust of the patient who was harmed. Nepal Despite nine development plans spanning five decades, Nepal remains one of the world’s poorest countries. Nepal’s underdevelopment is a result of the historical effects of unequal distribution of assets and social and economic status among different groups, and effects of recent development efforts that have generated further iniquitous income and assets distribution. Understanding Nepal’s underdevelopment has become particularly pressing in light of the Maoist insurgency that began in 1996. In addition to the deaths of more than 6,000 civilians, instability has caused economic stagnation, discouraged foreign investment, and prevented the expansion of the hydropower and tourism industries. Nepal’s future depends on an understanding of how its institutions have created inequity, and how it will respond to the need for institutional reform. Culturally, Nepal is a patriarchal and hierarchical society. Caste is important in the world’s only Hindu nation. Gender, ethnicity, land ownership, and location are also historically important social determinants. Nepal’s history and geography have contributed to the perpetuation of these cultural values. Historically, Nepal has been very isolated. Situated between China and India, it is bisected by the Himalayas. The country is divided into three bands running from east to west – the Himalayas furthest north, the flat and dry Terai in the South, and the middle hills sandwiched in between. Extreme differences in topography, and a lack of roadways and efficient transportation, have meant that communities tended to remain isolated and distinct, closely linked to traditional cultural practices and norms. 1. When reviewing the legal requirements to acquire an admissible statement, what similarities did you find among the four states? In general the similarities among the four states pertain to the use of public records such as religious ones, family history, documents more than 20 years old, recorded recollections, the absence of public records, vital statistics, statements about the declarant’s present sense impressions or the declarant’s the existing mental, physical or emotional state, statements about the person’s medical condition. Arizona, Illinois and New York also allow telephone conversations to be admitted into evidence as long as one part has consented to such recording (Pilgrim Software, 2007). 2. What differences did you find among the four states? California requires both parties’ consent to telephone conversation recording for the telephone call to be admitted as evidence (Pilgrim Software, 2007). California has admitted hearsay statements by victims who were murdered, as demonstrated by the (Colb, 2008) Giles v. California. New York Evidence Law (2006) does not allow prior consistent statements. They can only be used to disprove misassigned motive, as demonstrated by People v. Seit, 86 N.Y.2d 92 (1995) (p. 15).However, New York has made exceptions to such statements when they apply to present impressions (p. 15). Out-of-court identifications made by persons not present is treated as hearsay (p. 15). This is also true for California (DiCarlo, 2001). In Arizona, former testimony in a non-criminal action or proceeding is admissible. If it relates to criminal actions or proceedings it is inadmissible (â€Å"Arizona rules,† 2009). Yet, Arizona allows firsthand written accounts of the person’s activities or routines (2009). Illinois (2011) contends that one must â€Å"[†¦] prove the content of a writing, recording, or photograph, the original writing, recording, or photograph is required, except as otherwise provided in these rules or by statute† in order to be admitted. If the original is unavailable, exceptions might be made (2011). 3. What do you consider the most interesting concept regarding your comparison of admissible statements for these states? Perhaps, the most interesting concept regarding the comparison of admissible statements and hearsay exceptions for these states lie within the small and pivotal differences between them. Almost every difference is explained by a court case in that particular state. when one considers that each state has a few exceptions to the federal rules of evidence and hearsay, I cannot help but wonder whether such exceptions are constitutional.

Christian Philosophy of Education The Christian philosophy of education is that we will live our lives in a way in which God is reflected on what we do. Graham states, Education is the process whereby we learn to act like God and to do His work. As we commune with God in that process, and as we study His creation we are able to do the work that He has called us to do and do it in His ways (pg.50) The Christian philosophy of education is that if a person receives an education based on what God expects from us we will see the positive effects of a person with morals, respect, and love. Once a person has learned what is Christian life should look like they can go out to the world and teach others as well. Receiving a Christian education, students will learn the Christian beliefs and be able to understand them, as well as to integrate those beliefs into the rest of the school subjects. Every human being has a purpose in life. If a child receives a Christian education at school as well as at home, they will learn what that purpose is and how to use it in a beneficial way. The reason why someone chooses to give their children a Christian education is to create a person who will follow the path that God wants them to take. The way that people will learn how to behave or how to be more Christian like will be to study and read the bible as well as to utilize the teachers who are supposed to be guiding them in the correct direction. When a person is knowledgeable about the bible and being Christian, they are able to implement those beliefs into any other subject, including, science, history, art, math, or whatever other subject the children are supposed to be learning. The Christian philosophy of education also consists of helping children understand what God wants from us and feel it in their hearts. Children are not just supposed to learn something from a book without feeling it, like it is done with all the other textbooks very often. Bartlett, John C. (2007), states, It is imperative that Christians develop a philosophy of education based on the truth of the Scriptures and a complete understanding of Godrs desire that man enter a relationship with him. This philosophy of education is based on two distinct realities: 1) God desires a relationship with every individual; therefore, education must have the purpose to develop and nurture such a relationship. 2) Every individual has a unique purpose in life as defined by God; therefore, education must prepare every student to fulfill their God given purpose. It is important that a person who says they are Christians knows how to live their life because many others may follow in their footsteps and th e purpose might be to teach others how God wants us to live our life. Implications for Educational Practice As a School counselor, it is important to understand that everyone is different, and everyone deserves the same respect and love because this is what we have been taught as Christian believers. The implications in being successful as a teacher or a school counselor would be to help students reach their academic goals as well as deal with situation that they have to face in life. Using our knowledge, not only academically but in faith we will be able to support and encourage our students in whatever it is that we have to deal with along with them. While doing this as Christian educators we should keep in mind, how we can guide them in the direction that they will follow the purpose that God has for them whether it is academically or in their personal circumstance. When we are trying to tell someone that there is a certain way in which we should live our life and we tell them that this is what God would want us to do, we should be an example for them. (Titus 2: 7-8) Do what is good. Set an example for them in everything. When you teach, be honest and serious. No one can question the truth So teach what is true. Then those who oppose you will be ashamed. Thatrs because they will have nothing ad to say about us. Our worldview might be living our life to do as God wants us to. This scripture could not be more accurate, if we want others to live in a way in which we believe it is the correct way we should do the same. It does not matter if our students are looking at us or not, this should be something within our heart, that we know what is right and what is wrong. The Liberty University Conceptual Frameworks is the best example of what a Christian education is based on. First, educators must make sure that the student knows the Christian values, moral dimensions, and ethical implications synthesized with academic knowledge. Second, they will teach students the skills as a gift from God, because teaching/leadership is a calling from God. Third, the students must believe and practice personal integrity, social responsibility, sensitivity to the needs of others, and the betterment of humanity. Educators must understand what a responsibility it is to oversee children and what an important job it is to teach children and they must have the love to do this type of job. As I have mentioned before educators are called to live a life of good example for others. If we are the ones guiding, we should make sure that they are going in the direction where they are supposed to be heading. Graham states, As Godrs image bearers, Christian teachers are called to reflect the character of our creative redemptive God and to live according to His truth. The purpose of Christian education is to teach children about the love of God and know that we should try to mirror the actions of God which include, love, peace, forgiveness and acceptance of everyone, just to mention a few. Being Christian does not mean we are perfect, it means we keep trying to do better every day knowing that God forgives us and that we should let everyone around us know this as well.
